ROMs are illegal, PERIOD. There is no 24-hour rule. Having a cartridge of the game doesn't make it anymore legal.

Nothing post-video game crash are public domain. Everything pre-video game crash is public domain, and thus legal.

Homebrew, which is an original game made to work with an emulator is perfectly legal, as the creator is allowing this.

On a similar note, EMULATORS are completely legal.
