since i read that report on the kid that got arrested for selling modded xboxes, i was wondering : will we get arrested for portabilizing?

It's your hardware, do what you want. This guy was selling mod chips, which are illegal in the UK (where he is) and he sold the systems with them, not to mention pirated games (I'm pretty sure)
