well its been close to a month since my item was paid for on ebay, it was a pal super nintendo which I was really looking forward to getting it but I have yet to receive it. I have sent the seller 3 messages in the past two weeks, one of which was yesterday and I have not gotten a response from any of the messages. I will be leaving negative feedback regardless but I want your opinions. Its not a sketchy seller either. There a power seller with 100% feedback?

You should wait. Up here in Canada it usually takes three weeks to get something here from the states. It's actually faster if it's from China. Where abouts are you.

Anything I've ordered,even from china has taken about 2 weeks give or take. The auction ended august 6th.

If they're not responding, file the dispute. Up it to a claim or whatever as soon as you can. If you receive it in the meantime (about one month for to to close), you can say that you received it, and the seller won't be punished. They will only win the case if they can provide proof that it was delivered to you.

Wtf??
It says that a dispute cannot be filed at this time because the payment has not completed, I was charged the money and it even states on my paypal:

Uhm. Check your bank statements. They're more trustworthy than paypal.

Did you try initiating the dispute from within paypal?

Paypal <> eBay. They are different. In eBay you can "mark" things as paid without actually paying.

i bought somethng from a bh user and I got screwed. Paypal got me back my $$$, file it because you have a limited timeframe. Once had a seller force me to wait 45 days...By the time I realized I was being had, I couldn't do the complaint channel since the time had expired.

Ahh, all just a misunderstanding it seems. Got a reply today:
Hello, first let me say I am very sorry about what has happened. I dont know if you know about are situation down here in Calfornia and the fires. I am a reserve in the national guard and was called to duty. I just got back today. I can refund your money or I can ship it out today. Sorry for any inconvince I may have caused you please let me know what you would like to do
