Honestly, I don't think they care. If this writer at CNET can get away with encouraging people to edit ROMs of old Atari 2600 games, then I think they'll leave you alone. Sure, he's essentially encouraging illegal activity and CNET has a helluva lot to lose when compared to you (they'd be more likely to go after them), but like others have said, I don't think they care.
I wouldn't extend that to any company, though. Personally, I wouldn't even test Nintendo, as they have prosecuted in the past.

I think the reason they're tied to the console is because then people could download the same game to multiple Wiis or something. I'm not saying it isn't fair, I just think that's their logic. I mean, what's to stop someone from tying their friend's Wii to their account, download a game and then precede to download it to every Wii on that account? Once its on the Wii, its on the Wii.Negative_Creep wrote:

Now I don't think it would exactly break Nintendo if someone were to try that, as I'm sure it would probably be almost non-existent. But Nintendo can be paranoid (look at the whole friend code thing) and I think that's their logic.
They also don't let people with more than one copy of a system or game tie it to their account (at least not manually). If you want to tie another Wii or whatnot to your account, you have to contact them directly (I'm not sure if they revoke the previous one or not). I guess this is to discourage people from accumulating "stars" from their friends (although NOA doesn't do this, other countries do and NOA might just be laying the groundwork for that if they intend to, as stars are used for promotions and whatnot).
