Technically it's illegal as it's a violation of the EULA. It's specifically says that you are to use World of Warcraft on only Blizzard maintained servers, no private servers.
That's not to say that Blizzard is going to go after you like the RIAA would. They simply will brick your WoW if they find out, and may even make it so that you can't use your credit card or whatever to make a new account. Sucks but that's likely what will or could happen if they find out you're breaking their rules.
As far as morally illegal... Really I'd say you're doing nothing wrong. First and foremost it's putting the server maintenance issues on someone else, and really with over 8 million playing accounts, I don't thing Blizzard is going to be hurting for cash if some people where to go to private servers.
Me I know a friend who plays on a private server, and that sounds nice. But I like it how I can meet a lot different people. There are some people that I like to talk to (ventrilo) that I would never have met if I when with a private server.
Also considering I do work, I work for about two hours and I can pay for a whole month of WoW. So I don't see the cost as a big issue, though I can understand it as one for some of you that unfortunately can't/wont work for money.
