If you make a custom case for a n64. are you allowed to sell it lets say on ebay?

Sure, only potential issue should be if you infringe on any design patents with your case.

Such as making an exact duplicate of something that is patented. Which means you probably aren't going to run into any problems whatsoever. The hard part would be getting someone to actually buy it.
