It's not sealed, or even "like new". It says that it has "some surface scratches". It just comes in the box it came in. So it's OIB (Old In Box), not NIB.

They moved it from Forum 42 because the sole reason of this thread was a SNES. Yeah id say it was a little tore up too, defiantly not new.
