I understand that to play DS roms from a GBA flash cart you need a second device (a PassKey? PassMe?), but do you need such a mechanism to play homebrew emulators such as Gen or Snes (programmed for the DS, not GBA)?

Yes, it is still needed to force the DS to load the code off the GBA slot.

If you're getting one get a NoPass like the Datel Max Media Loader.

they wouldnt get sued but WILL get a cease and decist order.

Iris (PSMonkey's homebrew FPS) had a halo mod and immediately got taken down by an email from M$ themselves

I have that, just the CF card version instead. It's amazing! You can run Game Boy, Game Boy Color, and NES, all homebrow or the dreaded commercial romz. You can also use passme ot run NDS homebrew. It's waaaay cheaper than a GBA flashcard and comes with lots more functionality (yay movies).
