I'm pretty sure that it's a bootleg that would be illegal to sell in the US. It looks like it's not even a final release that they are selling.

There's a project to remake pokemon red; its called Shiny Gold.

But since that auction shows places from Gold/Silver, its probably a earlier revision of Heart Gold/Soul Silver that they are selling.

I'm pretty sure that's illegal.

EDIT: Actually, its a gold/silver remake. The pictures are straight up stolen from that project page.

Ebay doesn't even allow flash cards. But he's selling a rom, copied to a flash card (definitely illegal) and passing it as a legit game.

It's equivalent to selling a pirated copy of fire red, since that is what the game uses as a base.
