would it be illegal?

Post by ftf010 »

i painted my xbox 360 flat black and its got the hdmi imput so basically it looks and works like a xbox 360 elite (without the 120gb hard drive). Would it be illegal to sell it on ebay as a xbox 360 elite system?

I don't know about illegal, but that kind of deception is most definitely against e-Bay's selling regulations. If you're caught, you could get in a lot of trouble. I'm not sure about legal trouble, but you could be banned from e-Bay and PayPal for something like that.

Just list it as a black 360 with hdmi and 120gb hdd, and remind them that it's not an elite. There are xbox's on ebay with case mods for sale, this one is just black.

it is not, in fact, an xbox 360 elite, and it would be false-advertisement.

That would be fraudulent, and they can report you to eBay once they get their package and realize they got a regular 360 that's been spray-painted.

Besides, if it's a newer revision, don't you want to emphasize that?

False advertisement, I would say.

not to mention if it happens to get red rings and they register it on xbox.com... once that serial number is entered it will display what xbox 360 console they have (arcade, core, premium, elite, h3 edition, red elite) so i wouldn't sell it as elite, just do what that guy said.... sell it as a black 360 with (whatever)

And they could file a complaint, and paypal would take the money they paid you and give it back to the buyer.

Wow. That's a dumb as s**t chance to be taking. Pretty sure once the buyer goes to get on X-Box live, they'll find out they don't really have an elite.

EDIT: And what about the tamper seal, huh? You got a way to fake that, too?

I'm pretty sure the worst that could happen is that you lose your ebay account.

People do get money back through paypal if they file a complaint. It happened to a friend once, over an issue that was the buyer's fault, and, on top of that, they never sent the item back.

Illegal? Probably not. Against eBay policy? Definitely. Being a deceiving little jerk? Absolutely.

If you send it through USPS, it would be mail fraud, which is illegal.
