i painted my xbox 360 flat black and its got the hdmi imput so basically it looks and works like a xbox 360 elite (without the 120gb hard drive). Would it be illegal to sell it on ebay as a xbox 360 elite system?

I don't know about illegal, but that kind of deception is most definitely against e-Bay's selling regulations. If you're caught, you could get in a lot of trouble. I'm not sure about legal trouble, but you could be banned from e-Bay and PayPal for something like that.

Just list it as a black 360 with hdmi and 120gb hdd, and remind them that it's not an elite. There are xbox's on ebay with case mods for sale, this one is just black.

That would be fraudulent, and they can report you to eBay once they get their package and realize they got a regular 360 that's been spray-painted.

not to mention if it happens to get red rings and they register it on xbox.com... once that serial number is entered it will display what xbox 360 console they have (arcade, core, premium, elite, h3 edition, red elite) so i wouldn't sell it as elite, just do what that guy said.... sell it as a black 360 with (whatever)
