There's a technicality to get around most lower level laws

Actually, what gannon said is technically not completely true. Using an emulator to run a commercial game is legal as long as you purchased and own a physical copy of the game. For instance, I recently purchased a game cart for vectorman for the sega genesis. As of that time, even if I didn't own the console, I could legally play the game with an emulator on my computer.

onley if you dumped it yourself that is just an old wif...uhh I mean nerds tale although companys like nintendo dont relly go after nes dumps cause they are very old though still one of there main sourses of income so I dont know why not

according to the DMCA you aren't allowed to dump your own roms of commercial games (although the DMCA can be interpretted in many ways)

the way I understaned it you can dump um but you cant sell or distribute them outherwise known as "fair use"

btw im pretty shure DMCA cannot be applyed to NES games because they where out before 1998 if not I know it cannot be applyed to games dumped before the law was passed beause that would be unconsitutional

The DMCA Chapter 12, paragraph 1201. Forbids any circumvention of any security device on a media. For example even though you own a copy of the DVD you cant take to the computer run a de-CSS program to unencrype it, and then recompress it to say Divx or VCD, even though its a legal copy you own.

So what type of copy protection is there on a rom? Certainly copy protection is not defined as a different adapter. Do the dunper programs decrypt something?

To my knowlege roms dont have any security measures except hardware. The thing that really gets you introble about having roms of games are two things; one is that you cant use it without owning a legal copy (or 24 hours to try it out); two is that the game is copy written. Though I believe patients run out after about 10 years (in the U.S.), mario however is a registered trademark so you cant have that expire completely over time.

Copyright only means that you cannot market or sell a copy of a copyrighted item. If you look under the DCMA, it is legal to keep a backup copy of anything you own without any fear of legal recourse.
